Welcome to the ML Enterprise Inc. (which may also be referred to as "Engine by MoneyLion”, “Engine”, “Fiona”, “ML Enterprise”, “we”, “us”, or “our”) Privacy Policy. This Privacy Policy describes how we collect, use, and disclose your information in connection with our websites and platforms (the “Site”) and any other online content, tools, or services that we control and that link to this Privacy Policy. This Site is operated by Engine by MoneyLion and has been created to provide information to our visitors (“you,” “your”) about our company and our online content, tools and services, whether such content, tools and services are accessed on the Site or through third-party websites, mobile sites and/or applications (together with the Site, the “Service(s)”). This Privacy Policy describes how Engine by MoneyLion collects, uses and discloses information from visitors to the Services, including personally identifiable information (“Personal Information”).
Engine by MoneyLion provides a platform to help match consumer needs, whether they navigate directly to our Site or engage with one of our online forms, tools, widgets or content items on websites operated by third-party business partners (such partners, “Channel Partner(s)”) with the right personalized offers from lenders, credit card issuers, banks or other similarly situated financial institutions (such partners,“Financial Partner(s)”, and together with the Channel Partner(s), the “Marketplace Partner(s)”). For clarity, Engine by MoneyLion is not a lender, credit card issuer, bank or other similarly situated financial institution. Any loan or related product to which you may become a party by using our Services is solely transacted between you and the applicable Marketplace Partner, and is not a part of the Services. Should you navigate to the website of a Marketplace Partner or establish a direct relationship with a Marketplace Partner, that partner’s use of your Personal Information is governed by their own privacy policy, and not by this Privacy Policy.
WHY THIS MATTERS
We want to build an indispensable platform to aid people in making smart comparisons and connecting them to companies to help meet their financial needs. Knowing certain things about our users helps us do that better.
Please be sure to read this entire Privacy Policy before using or submitting information through the Services. By using or submitting information through the Services, you are indicating that you agree to the collection, transfer, manipulation, processing, storage, disclosure, and other uses of your Personal Information as described in this Privacy Policy, and you agree to be bound by the terms of this Privacy Policy. You also agree that such Personal Information may be transferred from your current location to our offices and servers, and to those of our Marketplace Partners.
This Privacy Policy is incorporated into Engine by MoneyLion’s Terms of Service and any other agreement entered into by and between you and Engine by MoneyLion.

Because we are a financial institution regulated under the Gramm-Leach-Bliley Act, the Personal Information that we collect in connection with your request for consumer financial products and services constitutes “nonpublic personal information” subject to our Financial Privacy Notice, and we may be exempt from certain state privacy laws.
When you visit the Site or use our Services, you signify acceptance to the terms of this Privacy Policy and the Financial Privacy Notice and consent to the collection, use, and disclosure of your Personal Information as described herein and therein.
I. PERSONAL INFORMATION THAT YOU PROVIDE OR AUTHORIZE US TO COLLECT
We collect Personal Information from you when you voluntarily provide such information, including, but not limited to, when you access, complete and/or use one of our online forms, tools, widgets or content items and direct us to share this information with our Marketplace Partners so that you may receive personalized offers for financial products and services. When you interact with our Services, we may also request your Credit Authorization to obtain consumer and related information about you from one or more consumer reporting agencies for the purposes of identifying the Financial Partners who would be the best match for you, and to disclose this information to these Financial Partners.
Upon your direction, our Service will compare the information you have provided with the qualification criteria maintained by our Financial Partners offering the product or service you requested. If you satisfy the criteria for certain of our Financial Partners to offer financial products or services, we will pass your Personal Information along to that subset of our Financial Partners.
The Personal Information you will be asked to provide when using our Services may vary depending on the type of financial product or service you are seeking, and may include:
A. CONTACT AND DEMOGRAPHIC INFORMATION, which may include your name, address, date of birth, phone number, Social Security number, driver’s license number, passport number, or other similar identifiers, age, citizenship, marital status, sex, and veteran or military status. To the extent that you apply for a loan or a financial product or service along with a co-applicant, we may also collect these categories of personal information for the co-applicant. This information may be directly provided by you, sourced from identity verification and fraud prevention partners or public databases, and/or obtained from consumer reporting agencies when we perform a soft credit pull with your authorization.
B. PROFESSIONAL OR EMPLOYMENT INFORMATION, such as education levels and degrees, institutions attended and graduation dates, employment status, and income and pay frequency. This information may be directly provided by you, and/or obtained from consumer reporting agencies when we perform a soft credit pull with your authorization.
C. FINANCIAL INFORMATION, such as your credit score, credit data status (for example, how long you’ve had a credit file, whether your credit is frozen), your credit, payment and bankruptcy histories, and the type and amount of any outstanding loans. This information may be directly provided by you, and/or obtained from consumer reporting agencies when we perform a soft credit pull with your authorization.
D. RESIDENCE AND HOMEOWNERSHIP INFORMATION, for example, whether you own or rent your home, and the amount of any mortgage payments. This information may be directly provided by you, and/or obtained from consumer reporting agencies when we perform a soft credit pull with your authorization.
E. AUTO LOAN INFORMATION, including information on monthly payments, estimated mileage, and your vehicle identification number. This information may be directly provided by you, and/or obtained from consumer reporting agencies when we perform a soft credit pull with your authorization.
F. COMMERCIAL INFORMATION, such as purchase information, including details related to products and services you purchase from our Financial Partners (for example, the amount of any loan you take out with a loan partner and the purpose for the loan).
G. HEALTH-RELATED INFORMATION, on a self-reported basis and to the extent that you apply for a life insurance product through our wholly-owned subsidiary, LeapLife. This may include sensitive personal information, for example, your height, weight, prescribed medications, tobacco and alcohol use information, diagnoses, surgical and treatment information, and whether you have recently been declined for life insurance coverage.
H. CRIMINAL HISTORY INFORMATION, on a self-reported basis and to the extent that you apply for a life insurance product through LeapLife - specifically, whether you have been convicted of a felony and been put on probation or parole.
I. SUPPORT INFORMATION, including audio, electronic or similar information, or the information collected when you email or call our customer support center, which may include your name, email address, voice recording, and any other content or communications you send to or share with us.
J. SURVEY INFORMATION, if you elect to complete surveys about your user experience.
K. SENSITIVE PERSONAL INFORMATION, such as your Social Security number, driver’s license number, passport number, or other similar identifiers, age, citizenship, marital status, sex, and veteran or military status. To the extent that you apply for a loan or a financial product or service along with a co-applicant, we may also collect the above categories of personal information for the co-applicant. This information may be directly provided by you, and/or obtained from consumer reporting agencies when we perform a soft credit pull with your authorization.
We may also collect business contact Personal Information in the context of business-to-business relationships to complete vendor and partner due diligence.
By voluntarily providing us with Personal Information, you represent that the Personal Information you provide is true, accurate, current and complete, and that you are authorized to provide it to us.

II. PERSONAL INFORMATION AUTOMATICALLY COLLECTED
Whenever you interact with the Services, Engine by MoneyLion may automatically receive and record information from your computer, browser and/or mobile device, which may include the following:
A. IP ADDRESS:
The requests you make to Engine by MoneyLion may contain your IP address (the Internet address of your computer). We may use visitors’ IP addresses for various purposes, including to display customized content, to analyze and report upon usage of the Services, to diagnose and prevent service or technology problems affecting the Services, and to monitor and prevent fraud and abuse. We may also use the IP address associated with your login to determine your general location in order to comply with applicable privacy regulations and serve you necessary notifications and/or consent mechanisms.
B. DEVICE IDs:
We may collect information on the type of device you are using, operating system, settings, browser and OS information, unique device identifiers, mobile carrier, browser type and language, network information and other device-specific information. The information collected may depend on the type of device you use and its settings. We collect this data to better tailor our services to you, and to audit ad impressions and compliance with various specifications and standards.
C. LOCATION DATA:
We may collect location data, which may include precise geolocation, based on your IP address and the geolocation of your device. We collect this data to better tailor our services to you and to help provide service offerings available to you in your geographic area.
D. USAGE INFORMATION:
We collect information about how you use our Services, such as the types and categories of content that you view or engage with, the features you use, the actions you take, and the time, frequency and duration of your activities on the Site. We use data analytics with this usage information to better understand your use of the Services and to improve the Services offered.
III. COOKIES, WEB BEACONS, AND SIMILAR TECHNOLOGIES
In operating the Services, we may use cookies, web beacons, fingerprinting, and similar technologies to collect and use Personal Information about you, including for analytics purposes and to serve you interest-based advertising. This Privacy Policy covers the use of these technologies by Engine by MoneyLion only. Uses of these technologies by third-party advertisers or websites linked from the Services, including third parties with which we partner, are governed by each such third party’s privacy policy.
A. COOKIES & ANALYTICS:
A cookie is a small text file placed in visitors’ computer browsers to store their preferences. Cookies help provide additional functionality to the Services, customize users’ experiences with the Services and help us analyze Services usage more accurately for research, advertising, and marketing purposes. On most web browsers, you will find a “help” section on the toolbar. Please refer to this section for information on how to receive notifications when you are receiving a new cookie and on how to turn cookies off. We recommend that you leave cookies turned on because they allow you to take advantage of some of the Services’ features, and, if you block or delete cookies, the Site may not work properly.

B. PIXEL TAGS/WEB BEACONS:
In addition to cookies, we may use web beacons (also known as “clear GIFs” or “pixel tags”), which are pieces of code embedded on the Site that collect information about users’ engagement on a web page. These help us to measure traffic to or from or use of our online forms, tools or content items, and related browsing behavior, and to improve your experience when using the Services. We may also use customized links or other similar technologies to track hyperlinks that you click, and we associate that information with your Personal Information in order to provide you with more focused communications. Web beacons may be placed on the Service by third parties, such as analytics providers, in order to support functionalities described in this Privacy Policy. The information collected by these third parties in this manner is subject to these third party’s own privacy policies.
C. SESSION REPLAY TECHNOLOGIES:
We also use research vendors, including session replay service providers, in order to better understand our users’ needs and to optimize our Services. Such technologies and third-party-provided services may observe or record user activities when using our Services, including certain movements, scrolling, visit duration, clicks, chatbot conversations and other interactions. These services may use cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Certain analytics may be removed via our privacy cookie controls.
D. “DO NOT TRACK”:
Please note that our Site currently does not respond to “Do Not Track” (DNT) signals and operates as described in this Privacy Policy, whether or not a DNT signal is received.
IV. PERSONAL INFORMATION COLLECTED FROM OTHER SOURCES:
We may collect Personal Information about you from third parties to operate the Site and to provide you with our Services. As previously discussed, this may include information about you from one or more consumer reporting agencies, for the purposes of identifying the Financial Partners who would be the best match for you. We may also collect any of the above categories of Personal Information from third parties, such as Marketplace Partners, advertising networks, internet service providers, data analytics providers, government entities, operating systems and platforms, social networks, public databases, and data brokers. We may also collect information about you from our corporate affiliates, which we use to streamline and personalize your experience with our Site and our Services.
We may also derive Personal Information about you in the form of inferences, which are derivations of information, data, assumptions, or conclusions from facts, evidence, or other sources of information or data about you. These inferences may be derived from the Personal Information that you provide to us or authorize us to collect, from the Personal Information automatically collected, from the Personal Information that we collect from third parties, as well as from the information collected by cookies, web beacons, and other tracking technologies.

- To provide information relevant to the underwriting models and eligibility criteria of the Financial Partners who may provide you with personalized offers.
- To personalize the Services when you visit our Site and/or use one of our online forms, tools, widgets or content items.
- To monitor your use of the Services.
- To maintain our Services and operations.
B) TO ENSURE THE INTEGRITY AND SECURITY OF OUR SERVICES
- To detect and protect against security incidents and malicious, deceptive, fraudulent or illegal activity, and prosecute the same.
- To debug to identify and repair errors in our systems.
- To verify or maintain the quality of our services, and to improve, upgrade, or enhance our services.
- To conduct due diligence or other reviews in connection with our vendor onboarding processes.
C) FOR ANALYTICS, RESEARCH, AND SERVICE IMPROVEMENT

- To conduct testing, research, and surveys, to understand how our Services are being used and how they can be improved.

- To pre-populate certain fields in our forms, helping to streamline your experience.
D) FOR QUALITY ASSURANCE AND TRAINING PURPOSES
- To monitor communications and interactions with you to ensure the quality of our support services and the appropriate training of our people, and to respond to and resolve your inquiries.
E) TO COMMUNICATE WITH YOU
- To contact you by email, postal mail, push notifications, in-app messages, phone or SMS, as permitted by applicable law, to provide you with:
- Information regarding your application status, or other transactional information relevant to your account.
- Opportunities, alerts, and promotions related to your submitted request available through the services or products of our Marketplace Partners that we think may be of interest to you.
- Information or content – such as articles, white papers, and event registrations – that we believe would be of interest to you.
- Each marketing-related e-mail communication we send you will contain instructions permitting you to “opt-out” of receiving future marketing communications. Generally, you can unsubscribe from our marketing emails or direct mail by submitting an unsubscribe request form or emailing [email protected] and asking to be removed from any correspondence. Although we will remove you from our marketing lists, you may still receive transactional messages related to your interactions with our Services. This process will not unsubscribe you from marketing communications from Marketplace Partners; in order to stop receiving these communications, please follow each partner’s own unsubscribe processes.
F) FOR PERSONALIZATION AND ADVERTISING
- To serve you with relevant advertising and content, which may include providing service offerings available in your geographic area, or to serve you with advertising for Marketplace Partner products or services, or the products or services of Engine by MoneyLion Related Companies (as defined below), on third party properties (cross-context behavioral advertising).
- To draw inferences to build a user profile reflecting your preferences, characteristics, or behavior, or to build aggregated user profiles and segments, which we may use to target “lookalike” audiences on other platforms or to improve our efforts to target appropriate advertising to you.
- To provide to Engine by MoneyLion Related Companies (as defined below) for marketing purposes.

- To display ads on the services of third-party advertising companies and social media companies.
- These companies may use cookies and similar technologies to track your activity, and the information collected by these third parties in this manner is subject to that third party’s own privacy policies.
- We may also use aggregated information from these sources for creating similar audiences in order to better target advertisements on their networks to potential consumers who appear to have shared characteristics. NOTE ON OUR USE OF AGGREGATED PERSONAL INFORMATION:
In an ongoing effort to better understand and serve our users, Engine by MoneyLion often conducts research on consumer demographics, interests, and behavior based on Personal Information and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and Engine by MoneyLion may share this aggregate data with our affiliates, agents, service providers, Marketplace Partners, and other third parties with whom we do business. This includes, but is not limited to, information such as consumer financial trends, choices, and comparisons. We may also use aggregated information from these sources to create similar audiences in order to better target advertisements on third-party advertising and social media networks to potential consumers who appear to have shared characteristics. Engine by MoneyLion may also disclose aggregated user statistics in order to describe our Services to current and prospective Marketplace Partners, and to other third parties for other lawful purposes. This aggregate information does not identify you personally. We will not attempt to re-identify the data once in aggregate or non-personally identifiable form.
- HOW WE DISCLOSE PERSONAL INFORMATION
We may disclose your Personal Information to the following categories of recipients for our business or commercial purposes:
A) ENGINE BY MONEYLION RELATED COMPANIES: We may disclose your Personal Information to our corporate parent entities, MoneyLion Technologies Inc. and MoneyLion Inc., and their wholly-owned subsidiaries and affiliates (collectively, “Related Companies”), for purposes consistent with this Privacy Policy (including for marketing and advertising purposes).
B) THIRD-PARTY SERVICE PROVIDERS: Engine by MoneyLion, like many businesses, hires other companies and contractors to provide certain business-related services (for example, facilitating mailings, maintaining databases, providing customer service, cloud storage providers, and business analytics and marketing providers). We may also disclose this information to consumer reporting agencies, acting in a service provider capacity, as part of data studies intended to test the reliability of our internal data and improve the quality of our Services. When we employ another entity to perform a function of this nature, we only provide them with the information that they need to perform their specific function, and we ensure that we have appropriate contractual provisions protecting your Personal Information in place.
C) BUSINESS PARTNERS: When we partner with other businesses to provide content, products or services to you or to such business partners, we may disclose relevant Personal Information in connection with such content, products, or services. For example, we will disclose the information you provide when using our Services with Financial Partners whose pre-qualification criteria you may satisfy. In addition, if you originally engaged with our Services on a website or property owned and operated by a Channel Partner, we may provide summarized purchase information, on an aggregated and anonymized basis, back to such Channel Partner to support the accuracy of their financial and business analytics. We may also share this information with our Marketplace Partners to improve efforts to target appropriate advertising content to you.
D) CONSUMER REPORTING AGENCIES: We may disclose basic Personal Information to consumer reporting agencies, either for purposes of completing a “soft credit pull” with your authorization, or as part of data studies, with the consumer reporting agencies acting in a service provider capacity, which are intended to test the reliability of our internal data and improve the quality of our Services.
E) POTENTIAL PARTIES TO A CORPORATE TRANSACTION (AND THEIR AGENTS AND ADVISORS): We may disclose your Personal Information to actual or potential buyers (and their agents and advisors) in connection with any actual or proposed purchase, merger, acquisition, reorganization, financing, bankruptcy, receivership, sale of company assets, or transition of service to another provider. In this event, we will inform the transferee that it must use your Personal Information only for the purposes disclosed in this Privacy Policy.
F) LAW ENFORCEMENT BODIES, REGULATORS, GOVERNMENT AGENCIES, COURTS OR OTHER THIRD PARTIES: We may disclose your Personal Information to competent law enforcement bodies, regulators, our insurers, external legal advisors, government agencies, courts or other third parties where we believe disclosure is necessary: (i) to comply with applicable law; (ii) to exercise, establish, or defend our legal rights; (iii) to protect your rights or vital interests or those or any other person; or (iv) to detect, prevent, or otherwise address security, fraud, or technical issues.

If you choose to create an account, we may collect the same information described above in “What Personal Information We Collect” and/or other information to provide account related functionalities to our users. By registering, you agree to provide and maintain true, accurate, current, and complete information about yourself.
Please note that if you allow others to use your account (including others you permit to set up profiles under your account), they may be able to view information about your account or any of the profiles under your account.

DATA RETENTION:
We keep your Personal Information for only as long as necessary to provide you with the Services and for legitimate and essential business purposes, such as maintaining the performance of the website and associated services, making data-driven business decisions about new features and offerings, conducting audits, complying with our legal obligations, and resolving disputes. When we are no longer required to retain the Personal Information as described above, we will destroy, erase, or de-identify it. Legal data retention requirements, however, may require us to retain some or all of the Personal Information we hold for certain periods of time.
ACCURATE INFORMATION:
We rely on you to ensure your information is accurate and up-to-date. CHILDREN’S PRIVACY ONLINE:
The Services of Engine by MoneyLion are not directed to, or intended for, minors. Engine by MoneyLion does not knowingly collect Personal Information from minors. If you are under the age of 18, please do not submit any Personal Information through the Services. We encourage parents and legal guardians to monitor their minor children’s Internet usage and to help enforce our Privacy Policy by instructing their minor children never to provide Personal Information on the Services without their permission. If you have reason to believe that a minor has provided Personal Information to Engine by MoneyLion through the Services, please contact us, and we will delete that information from our databases.
LINKS TO OTHER WEBSITES:
This Privacy Policy applies only to the Services. The Services may contain links to other websites not operated or controlled by Engine by MoneyLion (the “Third-Party Sites”). The policies and procedures we described here do not apply to the Third-Party Sites. The links from the Services do not imply that Engine by MoneyLion endorses or has reviewed the Third-Party Sites. We suggest contacting those sites directly for information on their privacy policies.
SECURITY:
We take steps to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy. We maintain commercially reasonable administrative, technical and physical safeguards (which vary depending on the sensitivity of the Personal Information) designed to protect against unauthorized use, disclosure or access to Personal Information, and we regularly adapt these controls to respond to changing requirements and advances in technology.
However, no Internet or email transmission is ever fully secure or error free. SERVICE FOR U.S. USERS ONLY:
The Service is hosted and intended solely for consumers in the United States. All Personal Information is stored on servers in the United States and is subject to United States law. By choosing to use the Services or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the state of New York and the adjudication of any disputes arising in connection with the Services will be in accordance with the Terms of Service.
If you are visiting the Services from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and the global processing of such information. By providing your information you consent to any transfer and processing in accordance with this Privacy Policy.
UPDATES TO ENGINE BY MONEYLION’S PRIVACY POLICY:
We may update our Privacy Policy from time to time to reflect changes to our businesses and to account for changing privacy laws. Because we are a financial institution regulated under the Gramm-Leach-Bliley Act, the Personal Information that we collect in connection with your request for consumer financial products and services constitutes “nonpublic personal information” subject to our Financial Privacy Notice, and we may be exempt from certain state privacy laws. Please note that Engine by MoneyLion only uses or discloses your sensitive Personal Information as permitted under applicable law, and that such use or disclosure is reasonably necessary and proportionate for those purposes. As such, our use and disclosure of your sensitive personal information is already limited. Please note that we do not use your sensitive Personal Information to infer characteristics about you.
- Right to Opt-Out of Sale, Sharing, or Use for Targeted Advertising: Some states allow residents to have the right to opt out of disclosures of Personal Information to third parties for monetary or other valuable consideration (which may be considered a “sale” even if no money is exchanged). You may also have the right to opt out of our “sharing” your Personal Information for the purposes of cross-contextual behavioral advertising. Our use of cookies, pixels, and similar tracking technologies may constitute “sharing” under some state laws.

We do not have any knowledge of the sale or share of Personal Information of those under 18 years of age.

In addition to these rights, pursuant to California’s “Shine the Light” law, California residents who share Personal Information with us have the right to request and obtain from us once per year, free of charge, a list of the third parties to whom we have disclosed their Personal Information (if any) for direct marketing purposes in the prior 12 months, as well as the type of Personal Information disclosed to those parties. C. HOW TO EXERCISE YOUR PRIVACY RIGHTS
I. Submission

You may exercise these rights yourself or via an authorized agent. If you have provided an authorized agent with a power of attorney pursuant to your state’s Probate Code, we will work directly with your authorized agent to complete your request. Where you have not provided an authorized agent with a power of attorney pursuant to your state’s Probate Code, we will reach out to you directly to confirm the authorized agent’s authority and collect the Verification Information (as defined below).
We do not typically charge a fee to fully respond to your requests, but we may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.
II. Verification and Response
We are required to verify the requests we receive when you exercise privacy rights. We (or third parties we engage to assist us) may ask you to provide certain information to us in order for us to verify your request, including your name, state of residence, email address, Engine by MoneyLion account login, date of birth, and other data points as needed to verify that you are who you say you are (the “Verification Information”). If we are unable to locate you in our records, or we are unable to verify your identity, we will be unable to fulfill your privacy rights request.
If we are able to successfully verify your request, we will respond within the timeframes prescribed by applicable laws.
III. Appeals
We make every effort to fulfill your request. However, we reserve the right to deny requests as permitted by applicable state law, such as where your identity cannot be confirmed, where we have a reasonable belief that the request is fraudulent, or where we must retain your information to comply with retention requirements under applicable laws.
Depending on your state of residence, you may have the right to appeal a decision made in response to your request.

ML Enterprise Inc.("Engine by MoneyLion", "Engine”, “Even Financial”, “we”, “us”, “our”) provides our Services (described below) to you through our website located at https://www.engine.tech (the “Site”) and through our online content, tools and services related to the marketplace, whether accessed on the Site or through third-party websites, mobile sites and/or applications (collectively, such services, including any new features and applications, and the Site, the “Services”), subject to the following Terms of Service (as amended from time to time, these “Terms of Service”).
We reserve the right, in our sole discretion, to change or modify portions of these Terms of Service at any time without further notice. You should periodically visit this page to review the current Terms of Service so you are aware of any revisions to which you are bound. If we make any revisions, we will post them on this page and will indicate at the top of this page the date these Terms of Service were last revised. Services Description
We and our affiliates, through the services we provide, are intended only to assist you in your financial organization and decision making and is broad in scope. We are an independent comparison service provider that allows you to obtain general information, including but not limited to, the ability to find third-party financial providers, for certain financial request services and products. The Services are designed to provide consumers information about various lenders, issuers, financial institutions, nonbank financial institutions, and/or financial services providers and the marketplace lending market (collectively “financial providers”) through the Services’ content and tools. This includes, but is not limited to, information, content and tools related to products and/or services such as credit cards, savings accounts, personal loans, life insurance and student loans. Engine by MoneyLion provides such information, content and tools as part of the Services but is not a lending institution or other financially related service provider itself. Any product or service offered or related transaction to which you are a party is solely transacted between you and the applicable service provider and is not a part of the Services. We do not issue loans, credit cards or any other financial products nor do we act as an agent or advisor to you or any financial provider. Third-party financial request providers are solely responsible for any services they may provide to you.
All rates, fees, and terms are presented without guarantee and are subject to change pursuant to each provider's discretion and may not be available in all states or for all types of loans. There is no guarantee you will be approved or qualify for the advertised rates, fees, or terms presented. We do not guarantee acceptance into any particular program or specific terms or conditions with any financial provider; approval standards are established and maintained solely by financial providers. We do not guarantee that the rates offered include the lowest rates available in the market or the rate that will ultimately be charged. This website does not include all lending companies or all available lending offers that may be available to you.
Engine by MoneyLion also provides financial partners with information about prospective consumers, as described in our Privacy Policy.
Your personal financial situation is unique, and it is your responsibility to evaluate the information and content provided and before making any financial decisions. Your Registration Obligations
You may be required to register with Engine by MoneyLion in order to access and use certain features of the Services. If you choose to register for the Services, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the Services registration form or one of our tools or forms that appears on a third-party website, mobile site or application. Registration data, information that you enter into our tools or forms and certain other information about you are governed by our Privacy Policy at https://engine.tech/privacy-policy/. If you are under 18 years of age, you are not authorized to use the Services, with or without registering. Engine by MoneyLion will not be liable for any loss or damage arising from your failure to comply with this section.
Modifications to Services
Engine by MoneyLion reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that Engine by MoneyLion will not be liable to you or to any third party for any modification, suspension or discontinuance of the Services.
General Practices Regarding Use and Storage
You acknowledge that Engine by MoneyLion may establish general practices and limits concerning use of the Services, including without limitation the maximum period of time that data or other content will be retained by the Services and the maximum storage space that will be allotted on Engine by MoneyLion’s servers on your behalf. You agree that Engine by MoneyLion has no responsibility or liability for the deletion of or failure to store any data or other content maintained by or uploaded to the Services. In addition, as described herein, we will share information you submit to us with financial providers in order to provide our Services. By submitting an inquiry, signing up for an account, or otherwise inputting information on or through our Site, you give us permission to retain all such provided information, and any other information we collect or may receive about you. You further acknowledge that Engine by MoneyLion reserves the right to change these general practices and limits at any time, in our sole discretion, with or without notice.
Mobile Services
The Services include certain services that may be available via a mobile device, including (i) the ability to submit information or upload content to the Services via a mobile device and (ii) the ability to browse the Services and the Site from a mobile device (collectively, the “Mobile Services”). To the extent you access the Services through a mobile device, your wireless service carrier’s standard charges, data rates and other fees may apply. In addition, using certain Mobile Services may be prohibited or restricted by your carrier, and not all Mobile Services may work with all carriers or devices.
By voluntarily providing your phone number to ML Enterprise Inc. (whether doing business as “Engine by MoneyLion” or “Fiona”), you authorize ML Enterprise Inc. to call you to explore financial products and provide information regarding your account or transactions with us. If you opt-in to receiving text messages, you agree to receive text messages from us, and from our affiliates, agents, representatives, assigns, successors, and service providers (collectively, the “Messaging Parties”), for marketing purposes related to financial products and services offered by ML Enterprise Inc. You understand that you may be contacted through use of automated telephone dialing systems, artificial or prerecorded voice message systems and text messaging systems. You can opt out of receiving calls and text messages at any time by: calling 1-800-614-7505; sending us an email through [email protected]; or, to stop text messages, replying "STOP”. We will send you one final message to confirm that you have been unsubscribed. If you want to join again, just sign up as you did the first time. If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance. Carriers are not liable for delayed or undelivered messages. Message frequency varies. Message and data rates may apply. You authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to us or our service providers, for the duration of your business relationship, solely to help your carrier to identify you or your wireless device and to prevent fraud. You may be contacted at the telephone number(s) you have opted in to even if your telephone number is currently listed on any internal, corporate, state, federal or national Do-Not-Call (DNC) list. This consent is not required as a condition to purchase services. If you choose not to opt-in to receiving text messages, you may be unable to receive important information regarding your account. Electronic Notices and Communication
By using the Services, you agree that we may communicate with you electronically via email regarding security, privacy and administrative issues relating to your use of the Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Services or sending an email to you. You may have a legal right to receive this notice in writing. CONDITIONS OF USE
User Conduct
You are solely responsible for all information, data, text, software, messages or other materials (“content”) that you submit or upload to the Services or otherwise use via the Services. The following are examples of the kind of content and/or use that is illegal or prohibited by Engine by MoneyLion. Engine by MoneyLion reserves the right to investigate and take appropriate legal action against anyone who, in Engine by MoneyLion's sole discretion, violates this provision, including without limitation, removing the offending content from the Services, blocking such violator’s access to the Services and reporting the violator to law enforcement authorities. You agree to not use the Services to:
a) email or otherwise submit or upload any content that (i) infringes any intellectual property or other proprietary rights of any party; (ii) you do not have a right to submit or upload under any law or under contractual or fiduciary relationships; (iii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (iv) poses or creates a privacy or security risk to any person; (v) constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “contests,” “sweepstakes,” or any other form of solicitation; (vi) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful racially, ethnically or otherwise objectionable; or (vii) in the sole judgment of Engine by MoneyLion, is objectionable or which restricts or inhibits any other person from using or enjoying the Services, or which may expose Engine by MoneyLion or our users to any harm or liability of any type;
b) interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services; or
c) violate any applicable local, state, national or international law, or any regulations having the force of law;
d) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
e) solicit personal information;
f) harvest or collect email addresses or other contact information of other users from the Services by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
g) further or promote any criminal activity or enterprise; or
h) obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Services.
Special Notice for International Use; Export Controls
Software (defined in the section on “Intellectual Property Rights” below) available in connection with the Services and the transmission of applicable data, if any, is subject to United States export controls. No Software may be downloaded from the Services or otherwise exported or re-exported in violation of U.S. export laws. Your use of the Software is at your sole risk. Recognizing the global nature of the Internet, you agree to comply with all local rules and laws regarding your use of the Services, including as it concerns online conduct and acceptable content.
Commercial Use Not Permitted
Unless otherwise expressly authorized herein or in the Services, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes, any portion of the Services, use of the Services, or access to the Services.
Protected Areas
Certain areas of the Site and Services may be password restricted to registered users (“Password Areas”). If you are a registered user of the Password Areas, you agree that you are entirely responsible for maintaining the confidentiality of your password. You agree that you are entirely responsible for any and all activities which occur under your account, whether or not you are the individual who undertakes such activities. You agree that you are above 18 years of age. You agree to immediately notify Engine by MoneyLion of any unauthorized use of your account or any other breach of security in relation to the Site or Services known to you. If you choose to register for the Services, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Services’ registration form or one of our tools or forms that appears on a third-party website, mobile site, or application. Registration data, information that you enter into our tools or forms, and certain other information about you are governed by our Privacy Policy.
Feedback
We may also provide you opportunities to review our Services with comments, suggestions, survey answers, questions, through third-party review websites and other feedback regarding our Services. These communications may be provided to you via email, social media, surveys, or similar means. By submitting and providing your Feedback you consent to its use in any manner and for any purpose to optimize, improve, promote or market our Services in accordance with our Privacy Policy. Any dealings you have with third parties are between you and the third party and their privacy policy and terms.
If you are given an opportunity to submit free-form responses, you agree to provide relevant and responsible responses; refrain from including any sensitive information of any kind (e.g., credit card or bank account information). You further agree that any information or materials that you, or individuals acting on your behalf, provide will not be considered confidential or proprietary and that ML Enterprise Inc. or its affiliates cannot and will not be held responsible to protect such data if you were to include it in your responses.
INTELLECTUAL PROPERTY RIGHTS
Service Content, Software and Trademarks
You acknowledge and agree that the Services may contain content or features (“Service Content”) that are protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. Except as expressly authorized by Engine by MoneyLion, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Services or the Service Content, in whole or in part, except that the foregoing does not apply to your own User Content (as defined below) that you legally submit or upload to the Services. You may not remove or alter any proprietary notices or marks on the Services or any portion thereof. In connection with your use of the Services you will not engage in or use any data mining, robots, scraping or similar data gathering or extraction methods. Any use of the Services or the Service Content other than as specifically authorized herein is strictly prohibited. The technology and software underlying the Services or distributed in connection therewith is the property of Engine by MoneyLion, our affiliates and our financial providers (the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by Engine by MoneyLion.
The Engine by MoneyLion name and logos are trademarks and service marks of Engine by MoneyLion (collectively the "Engine by MoneyLion Trademarks”). Other company, product, and service names and logos used and displayed via the Services may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to Engine by MoneyLion. Nothing in these Terms of Service or the Services should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of Engine by MoneyLion Trademarks displayed on the Services, without our prior written permission in each instance. All goodwill generated from the use of the Engine by MoneyLion Trademarks will insure to our exclusive benefit.
Third-Party Material
Under no circumstances will Engine by MoneyLion be liable in any way for any content or materials of any third parties (including users), including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. You acknowledge that Engine by MoneyLion does not pre-screen content from third parties, but that Engine by MoneyLion and our designees will have the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the Services. Without limiting the foregoing, Engine by MoneyLion and our designees will have the right to remove any content that violates these Terms of Service or is deemed by Engine by MoneyLion, in our sole discretion, to be otherwise objectionable. You agree that you must evaluate, and bear all risks associated with the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.
User Content Transmitted Through the Service
With respect to the content or other materials you submit or upload to the Services (collectively, “User Content”), you represent and warrant that you own all right, title and interest in and to such User Content, including, without limitation, all copyright and rights of publicity contained therein. By uploading any User Content you hereby grant and will grant Engine by MoneyLion and our affiliated companies a nonexclusive, worldwide, royalty free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, store, modify and otherwise use your User Content in connection with the operation of the Services, in any form, medium or technology now known or later developed.
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Services (“Submissions”) provided by you to Engine by MoneyLion are non-confidential and Engine by MoneyLion will be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
You acknowledge and agree that Engine by MoneyLion may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms of Service; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property or personal safety of Engine by MoneyLion, our users and the public. You understand that the technical processing and transmission of the Services, including your content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
You acknowledge, agree and authorize that (a) your information may be sent to financial providers on your behalf, (b) your information may be used in order to make sure you are who you say you are, and to determine how much debt you currently have in order to determine your debt-to-income ratio, (c) such financial providers may obtain consumer reports and related information about you from one or more consumer reporting agencies, such as TransUnion, Experian and Equifax, and (d) your information may be used to make prequalification and other credit or insurance decisions.
Third Party Websites
The Services may provide, or third parties may provide, links or other access to other sites and resources on the Internet. Engine by MoneyLion has no control over and is not responsible for such sites and resources, and links to such sites and resources do not indicate Engine by MoneyLion's endorsement of or affiliation with such sites and resources. You further acknowledge and agree that Engine by MoneyLion will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, events, goods or services available on or through any such site or resource. Any dealings you have with third parties found while using the Services are between you and the third party, and you agree that Engine by MoneyLion is not liable for any loss or claim that you may have against any such third party.
Indemnity and Release
You agree to release, indemnify and hold Engine by MoneyLion and our affiliates and our and their officers, employees, directors and agents harmless from any and all losses, damages, expenses, including reasonable attorneys’ fees, rights, claims, actions of any kind and injury (including death) arising out of or relating to your use of the Services, any User Content, your connection to the Services, your violation of these Terms of Service or your violation of any rights of another. If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” If you are a resident of another jurisdiction, you waive any comparable statute or doctrine.
CONSENT FOR ELECTRONIC SIGNATURES, RECORDS, AND DISCLOSURES (“E-CONSENT”)

This E-Consent applies to all interactions online concerning you, Engine by MoneyLion, and the service provider and includes those interactions engaged in on any mobile device, including phones, smart-phones, and tablets. By exercising this E-Consent, Engine by MoneyLion, the service provider may process your information and interact during all online interactions with you electronically. Engine by MoneyLion, the service provider may also send you notices electronically related to its interactions and transactions. Disclosures may be provided online at our or the financial providers’ websites, and may be provided by email.
Consenting to Do Business Electronically
Before you decide to do business electronically with Engine by MoneyLion and/or the financial providers, you should consider whether you have the required hardware and software capabilities described below.

Withdrawing Consent
Your E-Consent for our matching service and for our financial providers’ consideration of your matching request cannot be withdrawn because it is a one-time transaction. If you are matched with one or more financial providers, you are free to withdraw your E-Consent with Engine by MoneyLion and/or financial providers at any time and at no charge. However, if you withdraw this E-Consent before receiving credit, you may be prevented from obtaining credit from the service provider. Contact Engine by MoneyLion and/or service provider directly if you wish to withdraw this E-Consent. If you decide to withdraw this E-Consent, the legal effectiveness, validity and enforceability of prior electronic Disclosures will not be affected.
Change to Your Contact Information
You should keep Engine by MoneyLion and/or the financial providers informed of any change in your electronic address or mailing address. You may update such information by logging into Engine by MoneyLion and/or the financial provider’s website or by sending Engine by MoneyLion and/or the service provider a written update by mail.

Dispute Resolution
Any controversy or claim arising out of or relating to these Terms of Service or the breach thereof shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules (including the Optional Rules for Emergency Measures of Protection), and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The arbitration proceedings shall be conducted before one (1) neutral arbitrator selected by the American Arbitration Association. The place of arbitration shall be New York, New York. Either party may apply to the arbitrator seeking injunctive relief until the arbitration award is rendered or the controversy is otherwise resolved. Either party may, without waiving any remedy under these Terms of Service, seek from any court having jurisdiction any interim or provisional relief that is necessary to protect the rights or property of that party, pending the establishment of the arbitral tribunal (or pending the arbitral tribunal’s determination of the merits of the controversy).
Termination
You agree that Engine by MoneyLion, in our sole discretion, may suspend or terminate your use of the Services and remove and discard any content within the Services for any reason, including, without limitation, for lack of use or if Engine by MoneyLion believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Service. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of your use of the Services may be referred to appropriate law enforcement authorities. Engine by MoneyLion may also in our sole discretion and at any time discontinue providing the Services or any part thereof, with or without notice. You agree that any termination of your access to the Services under any provision of these Terms of Service may be effected without prior notice, and acknowledge and agree that Engine by MoneyLion may immediately delete any information you have submitted or uploaded to the Services and/or bar any further access to such information or the Services. Further, you agree that Engine by MoneyLion will not be liable to you or any third party for any termination of your access to the Services, and that Engine by MoneyLion may take any measures we deem necessary to restrict access to the Services, including blocking IP addresses.
User Disputes
You agree that you are solely responsible for your interactions with financial providers or any services about which you obtain information through the Services, and Engine by MoneyLion will have no liability or responsibility with respect thereto. Engine by MoneyLion reserves the right, but has no obligation, to become involved in any way with disputes between you and any such financial providers or services.
General
These Terms of Service constitute the entire agreement between you and Engine by MoneyLion and govern your use of the Services, superseding any prior agreements between you and Engine by MoneyLion with respect to the Services. You also may be subject to additional terms and conditions that may apply when you use affiliate or third-party services, third-party content or third-party software. These Terms of Service will be governed by the laws of the State of New York without regard to its conflict of law provisions. With respect to any disputes or claims not subject to arbitration as set forth above, you and Engine by MoneyLion agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within New York, New York. The failure of Engine by MoneyLion to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of such right or provision. If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Service remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or these Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred. A printed version of this agreement and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. You may not assign these Terms of Service without the prior written consent of Engine by MoneyLion, but Engine by MoneyLion may assign or transfer these Terms of Service, in whole or in part, without restriction. The section titles in these Terms of Service are for convenience only and have no legal or contractual effect. Notices to you may be made via either email or regular mail. The Services may also provide notices to you of changes to these Terms of Service or other matters by displaying notices or links to notices generally on the Services.

Annual Percentage Rate (APR) Disclosure: The Annual Percentage Rate (APR) is the rate at which your loan accrues interest. Representative Example: If you borrow $5,000 with a 36 month repayment term, and a 10% APR, the monthly payment amount will be $161.34. Total repayment will be $5,808.24. Total interest paid will be $808.24.
Representative Example (Credit Cards): If you have a $5,000 balance remaining at a 15% APR. Your end of day balance would be $5,000 after the first day., Assuming no purchases or payments, your balance at the end of the second day would be $5000, plus $2.05 in interest that accrued on the previous day’s balance ($5000*(0.15/365)). This would repeat every day until the end of the billing period. If there are no fees or other charges monthly repayment may be $5,061.50.

Any information you provide to Engine by MoneyLion pursuant to a request for mortgage product offers may be shared with the Financial Institution Providers on our platform in furtherance of your request.These Financial Institution Providers may retain your information provided to them by Engine by MoneyLion regardless of whether or not you obtain a loan from them.
The TILA-RESPA Integrated Disclosure Act, requires Financial Institution Providers to include a Good Faith Estimate (GFE), also referred to as a Loan Estimate Form, with any firm offers of credit they extend to you pursuant to an application you submit directly to that provider. This document sets forth the various loan terms and costs involved, such as a credit report fee, property appraisal fee, or other third-party fees in connection with your loan.
The interest rate reflected in any offers presented to you are subject to change without notice, unless and until you and the Financial Institution Provider have entered into an interest rate lock-in agreement.. The refundability of any fees associated with an interest rate lock-in agreement will be set forth in the terms and conditions of that agreement.
If your home value is higher than your outstanding mortgage balance(s), you may be able to borrow against the portion of equity available in your home. Under the ECOA, you are entitled to receive a copy of any appraisal.
A Home Equity Line of Credit (HELOC) is a line of credit that is secured by your home. Some HELOC products offered on Engine by MoneyLion’s platform have variable interest rates. These variable interest rates may go up or down in relation to an index, economic conditions, and/or the terms of the loan agreement. Some HELOC products may be subject to interest rate adjustment caps that limit the range of fluctuation of your interest rate for a set period (i.e. 6 months or 1 year) and for the life of the loan. Example: A Variable Rate HELOC with interest rate caps of 2% for the first year and 1% each year afterward for the life of the loan.
HELOC Annual Percentage Rate (APR) Disclosure:
Rates and terms may change at any time and will be subject to property type, loan amount, credit history, lien position, loan-to-value (LTV) ratio, debt-to-income (DTI) ratio, FICO score and draw amount at closing. Rates are subject to change daily and minimum line amounts may apply. All accounts are subject to individual lender approval. Any minimum periodic payments stated by a lender may result in a balloon payment if only the minimum is made. The amount and timing of the balloon payment is at the discretion of the lender. Please evaluate all terms prior to making any financial decision.

$300,000 x 80% = $240,000.
You owe $100,000 on your first mortgage: $240,000 – $100,000 = $140,000. In the above scenario, assuming your lender caps the maximum loan-to-value ratio of 80%, you could potentially qualify for a HELOC with a maximum credit line of $140,000.”

Types of Banking Products Offered on the Engine by MoneyLion Platform
- Money Market Accounts (MMA) are sometimes called money market deposit accounts or money market savings accounts. MMAs restrict withdrawals and payments to 6 times per month when using a check, debit card, draft, or electronic transfer. Withdrawals or payments by ATM, in person, by mail, messenger, or telephone check do not count against the 6 transactions per month limit.
- Cash Management Accounts (CMA) are cash accounts that combine services and features similar to those offered by traditional checking, savings, and investment accounts into one financial product. CMAs are offered by non-banking Financial Institution Providers such as brokerage firms.
- High Interest Checking Accounts (HIC) offers a higher interest rate (annual percentage yield, or APY) on money held in that account compared to other types of checking accounts.
- Certificate of Deposit (CD) is a type of savings account that earns interest on deposited funds for a fixed period of time ending with the “maturity date.” If funds are withdrawn prior to the maturity date penalties may be applied, including loss of interest.
Private Student Loans and Student Loan Refinance
Refinancing your federal student loan may result in the loss of certain benefits, and/or eligibility that apply to federal student loans. In addition, refinancing your student loan(s) may result in penalties, restrictions, or changes in your payment amount and terms. Refinancing your student loan(s) may not result in lower payments and in many cases can extend the life of the loan. Requirements, discounts, or other terms and conditions will vary by lender.

Auto Loan and Auto Loan Refinancing
Any offers you receive for auto loans or auto loan refinancing on Engine by MoneyLion’s platform do not include all costs that may be associated with an auto loan such as taxes, licensing, and fees. Other factors such as down payment, trade-in, rebates, and type of
automobile may impact the actual terms of the loan. Minimum and/or maximum loan amounts may be applied by the Financial Institution Provider based on several factors such as your income, credit history, and the vehicle you are purchasing or refinancing. Restrictions as to the type and age of vehicle you are purchasing or refinancing, as well as other characteristics may also apply. Refinancing your auto loan may not always result in lower payments and in many cases it can extend the life of the loan.
Auto Loans or Auto Refinance Loans are a type of secured loan. This means the vehicle financed by the loan will be used as collateral to satisfy the loan in the event you become unable to pay according to the terms of the loan. In some cases, the Financial Institution Provider may hold a lien on the collateral until the loan is fully repaid.

I. Nature of Relationship
We operate an online platform that provides a loan matching service and offers information about loans and other financial products and services to consumers. We are not a lender or correspondent lender. We do not make mortgage loans or commitments or take applications and cannot guarantee acceptance into any particular loan program by any Lender, or specific loan terms or conditions. We are an independent contractor and do not act as an agent or advisor to you or any financial service provider. We enter into mortgage loan brokerage contracts with consumers only to the extent required by state law. Any loan may be co-brokered but not in South Carolina. This Notice does not create an exclusive relationship and remains in effect only as long as you seek to use our services. You may discontinue this relationship at any time, without notice, at no cost or penalty to you.
II. Services and Duties
In order to operate our online platform and loan matching service in compliance with law, we are required to be licensed in some states as a mortgage loan broker and/or mortgage loan originator. However, we do not act as a lender or credit provider. We do not take applications, make loans or credit decisions in connection with loans, issue commitments or lock-in agreements, or fund loans. Our services are purely administrative. You are not required to use our computerized loan matching services in order to obtain a residential mortgage loan.
We will perform the following services for you: (1) make loan request forms available to you; (2) transmit your completed loan request to participating lenders in our network; (3) offer you access to general educational information concerning home financing including glossaries, articles, and calculators; and (4) send you the initial loan offers from lenders responding to your loan request.
Any loan request you submit is NOT an application for credit. Rather, it is a request to be matched with prospective third-party lenders to receive conditional loan offers from those lenders. Any lender will require you to submit a loan application to them for their consideration before extending an offer. One or more lenders may provide you with their loan product offers.
We do not issue loan approvals, loan commitments, or make any guarantees on behalf of any lender. We do not connect you with every lender in the market, so other lenders and loans not listed on our service may be available to you, and those other loans may have different terms and conditions, including lower rates. We cannot guarantee the lowest price or best terms available in the market. We do not endorse or recommend particular lenders or products. Your personal financial situation is unique, and it is your responsibility to evaluate the information and content provided, before making any financial decisions. You should rely on your own judgment in deciding which available loan product, terms, and lender best suits your needs and financial means or consider obtaining additional information and/or advice from a qualified financial advisor who is fully aware of your individual circumstances.
The lenders are solely responsible for their services to you, and you agree that we will not be liable for any damages or costs of any type arising out of or in any way connected with your use of such services. You understand that lenders may keep your loan request information and any other information provided by us or received by them in the processing of your loan request, whether or not you are qualified for a loan with them or obtain a loan from them. You agree to notify any particular lender directly if you no longer want to receive communications.
III. Compensation and Fees
We provide our services at no cost to you and will not charge or seek fees of any kind from you. We may, however, receive compensation from lenders in different amounts for different products or services, ranging from $1.00 TO $1,000,000.00 and may be paid based on the goods, facilities, or services performed or provided by us to lenders. We will be compensated in compliance with Section 1026.36(d) of Regulation Z (12 CFR 1026.36(d)) (as applicable). The lenders or other service providers may charge you fees in connection with the loans or other products they offer. The amount of any fee will be determined by the lender.
If your loan request is forwarded to a prospective lender that makes you an offer, you should receive from the lender a disclosure, sometimes referred to as a good faith estimate (GFE) of the settlement costs of your loan, and now generally referred to as a Loan Estimate form as required by the TILA-RESPA Integrated Disclosure Act. The disclosure sets forth the various loan terms and costs involved, such as a credit report fee, property appraisal fee, or other third-party fees in connection with your loan.
The interest rate quoted in connection with the loan you select is subject to change without notice, unless and until an interest rate lock-in agreement has been entered into between you and the lender. We do not offer interest rate lock-in agreements and do not guarantee any interest rate quoted by a participating lender. If you enter a lock-in agreement with the lender and are required to pay an interest rate lock-in fee, the terms and conditions under which the interest rate lock-in fee may be refunded, if any, will be set by the lender. The documentation you receive will include the information or terms and conditions on the refundability of any fees paid. We do not offer or provide any refund on behalf of any lender.
IV. Fair Lending Compliance
We support the principles of the federal Equal Credit Opportunity Act (the “ECOA”). We do not engage in business practices that discriminate on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to contract), the fact that all or part of the applicant's income derives from a public assistance program, or the fact that the applicant has in good faith exercised any right under the Consumer Credit Protection Act. Similarly, we are committed to compliance with any applicable state and local anti-discrimination laws. Under the ECOA, you are entitled to receive a copy of any appraisal.
